Agent act against the customer in Valencia

The international real estate agency and its operations in Valencia have been the subject of my previous articles. The company’s areas of operation include Barcelona, Costa Brava, Valencia, Madrid, Ibiza, and Portugal. The company emphasizes international expertise and cooperation on its website. We have personal experiences with the company in question in the village of El Puig de Santa Maria, north of Valencia.

Housing transactions

Our house was bought by a local couple. The transactions were made at the village notary’s office, which I have also written about before. The notary knew his own authority. Everything had to go strictly according to the manual. The sales contract stated that the seller was responsible for all unpaid bills and that the IBI would be divided between the seller and the buyer, since the transactions were made in the summer. This is common practice in Spain. We have made several housing transactions and have always followed the same formula. This is how it should be done so that the new owners avoid having to settle any unpaid bills from the previous owners. The annual IBI of our apartment was around 400 euros, half of which, around 200 euros, was deducted from the purchase price.

Threats and blackmail

A couple of weeks ago, our former agent B sent a message via WhatsApp and announced that he had been contacted by the Spanish buyer D of our house and that he was collecting unpaid IBI from us for the year 2024. Buyer D, the current owner of the property, had received a note for the amount because the IBI for 2024 had still not been paid, and the amount had risen to 600 euros. If the IBI was not paid immediately, it would be collected. Our ex-agent B sent a message threatening that the current owner D would send us a BUROFAX from their future lawyer if we did not pay the bill immediately. Our agent B and the current owner of the house believed that if we owned the property on 1.1. 2024, then we should pay the entire year’s IBI, even though half of it had already been taken from the purchase price. Owner D wanted to convey through our agent a threat that our property would be seized unless we acted, and he would take legal action.

Attack is the best defense

We sent a message to agent B and told him that the current situation is very confusing because we hired him as our agent, but our assignment ended after the transaction. He has since acted as the house buyer’s agent for the second time, because he is forwarding their messages and suggesting that we have somehow tried to avoid some payments and acted incorrectly. We expressed our hope that he would understand his position and stop forwarding third-party messages. Agent B then transferred the message to our Spanish sales manager M, who continued to harass us. The company advertises itself as an international company, but sales manager M does not know or want to communicate with us in English. Not a very constructive action in this situation. On the company’s website, he says about himself: ”After working in the real estate industry for nine years, I have learned that good relationships with both clients and my team are based on professionalism, respect, and honesty.” He doesn’t respect us, but continues that the property of the owner couple will have to be confiscated because we have no property in the country if we don’t pay the bill immediately. The amount of the bill has increased because they haven’t done anything about it for two years. The company is dishonestly, or should I say, against good professional practice, defending the victimizing couple. Quite a narcissistic situation. There is no self-reflection on the other side.

After-sales services

Many real estate agencies advertise after-sales services to their own paying clients. This company has spent time and resources on a couple who are not their clients. A year ago, the same couple contacted us through agent B, claiming that we were supposed to have some pipe connections under the street in front of the house repaired, and since this had not been done, they demanded compensation from us. We had exceptionally ordered a basic condition inspection of our house, which we sent to Agent B, and we stated that it was not our responsibility to take care of the pipe running under the street. Quite a comical idea that we would start on our own to find out what condition the pipes running under the street are in and possibly have them repaired. The whole case was taken out of the blue because Agent B and the current owners never came back to the matter, but a good company tries to make us pay for something that does not belong to us.

No settlement proposal whatsoever

Fortunately, we have the messages from the other party saved, in which the owner D admits that half of the 2024 IBI has been deducted from our purchase price. Buyer D writes that he went to the Valencian Regional Council with his wife and was told that the town hall had sent several IBI invoices in the name of the former owner to a different address than the property itself, but that the invoice had not been paid. The message from owner D to us: ”I am writing to you because I have received a demand for payment of the 2024 property tax (IBI). As you know, the owner is liable for the IBI from 1 January, and according to the contract, the seller would pay the 2024 IBI. We went to the town hall, and the seller has not made the payment despite several reminders. Now the Valencian Regional Council is demanding payment of the IBI with additional fees, as I am secondarily liable.” The buyer couple has our contact details. Why haven’t they contacted us and asked about the bill already in 2024 if there was something unclear about it? Of course, we would have been willing to negotiate.

Updating invoices

We have never received an IBI invoice at our home address in Finland. We do not own any property or apartment in Spain. Invoices and other mail are not updated in the system immediately, but can arrive in the names of the previous owners even years later. This is exactly what happened to us with the property in question; the mail from the previous owners ended up in the mailbox. They did not concern the property itself, but they seemed important to the people concerned. I took the envelopes, got an interpreter, and went to clarify the matter at the town hall, Ayuntamiento del Puig de Santa Maria. The matter was sorted out, and no more invoices were received. If the current owners have not understood the matter and have not reacted to the invoice for a few years now, then who has acted wrongly? All invoices that concern the apartment they own must be addressed. How can we comment on the invoice without seeing it, other than for the current owner to send a picture of it via our agent B, who is already familiar with him, or by email? I don’t think the Spanish have time to do detective work and find out the residence and address of the previous owners, which in this case is not even in Spain. We have never received or seen the original IBI invoice for 2024.

Agent B continues…

This morning, I received a message from agent B, even though we had asked her to recuse herself from this case. She writes: ”I suggest that you talk to your agent Jenny – she helped you understand what this unpaid tax is about and who is actually responsible for it… at this point they state in all contracts that the unpaid bill will be transferred to you. I would like to remind you that I suggested working with our lawyer, which you refused and wanted to work with your own agent… the matter would have been resolved the next day with a notary’s decision.” So what would have been resolved the next day? The day after the transaction, we returned to our home country and have not been contacted regarding the real estate transaction in question. We indeed refused the high-paid lawyer offered by the company, but our own agent handled the tasks assigned to him well. The notary did not accept our legal representative, Jenny, because she did not have good enough Spanish language skills in the notary’s opinion, even though she has worked as a translator in a different agency helping Finnish clients. Therefore, we took legal representative F, offered by the real estate agency, who participated in the transaction and translated all the documents orally from Spanish to English. The notary initially demanded that they be translated into our native language, Finnish, but no one in Valencia knew Finnish. So, in retrospect, we have to give credit to the notary because he acted in our favor.

The company wanted to wash its hands of

In this case, there are some things that are surprising. First, the fact that buyer D did not contact the sellers, i.e., us, directly by email, but first contacted the agent F, who acted as our agent at the request of the notary. It turned out that agent F no longer works for the company, so buyer D contacted agent B. Buyer D wanted to involve a third party, a real estate agency, because he hoped to get support for himself, and this is what happened in this case. However, the responsibility for translating an important document lies with F, i.e., the company where F worked. We would never have accepted a clause that says that the sellers will first pay half of the IBI at the time of the sale and later the entire IBI for 2024. This is the most likely reason why the company is so strongly of the opinion that we should pay the invoice and thus get the matter off the agenda. The person who drew up the deed of sale, the notary, also has a responsibility if he records these things unclearly.

The willingness to settle disputes carries weight in court

In disputes, it is always worth trying to reach an agreement. It would be best to negotiate directly with the person concerned and not involve a third party, unless it is purposeful, as seems to be the case in this case. Threats and inappropriate behavior rarely produce a good outcome. Conciliation and respect for others help in reaching an agreement and also show a willingness to agree on the matter and not to dispute it before the court. On the other hand, if you cannot admit your own mistakes, it is very difficult to reach an agreement. No one in the company has questioned the behavior of the Spanish couple. Our task is to find evidence. The other party does not have to present evidence. It is enough that they have not paid the invoices, and the vendors need to pay for their mistakes. Agent B has made all these exchanges of messages possible through his own actions, even though he should have announced right away that he is not their case manager, but that they should hire their own case manager or lawyer.

Meillä on omakohtaisia kokemuksia kyseisestä yrityksestä Valencian pohjoispuolella sijaitsevassa kylässä El Puig de Santa Mariassa.

Asuntokaupat

Talomme osti paikallinen pariskunta. Kaupat tehtiin kylän notaarin toimistolla, josta olen aiemmin myös kirjoittanut. Notaari tunsi oman arvovaltansa.

Hyökkäys on paras puolustus

Melko narsistinen tilanne. Vastapuolella ei ole minkäänlaista itsereflektiota.

After sale palvelut

Monet kiinteistövälitysyritykset mainostavat after sale- palveluja maksaville omille asiakkailleen.

Ostajapariskunnalla on meidän yhteystiedot.

Halu sopia riitatapauksessa antaa painoarvoa oikeudessa

Meidän tehtäväksi on annettu todisteiden etsiminen.
