It has been two weeks long and the neighbor is continuing to build the terrace. For a few days, the site stood because the cement base had to harden. Still, the cement looks like a murmur, but work is done under the terrace, and an illegal extra room is about to be completed. The neighbor’s apartment is becoming dark because the room under construction takes all the view from the downstairs windows because there is no window in front of the room, but the doors. My husband reminds them that they are Romanians and from what country Mr. Dracula came from.
You live in an apartment where you make illegal
I got new information from a couple of my so-called sources of information, which were directed directly from the Generalitat Valenciana site regarding construction breakers. After reading, I was like swallowing the earth. First, we have to contact the municipality and make a complaint, as we have already made a second week ago. On behalf of the municipality, the authority will inspect the site and then require the demolition of the structure. We have been informed that a construction ban has been imposed on the site, which had to come into force this week. Now is Sunday and construction continues. If the demolition is not done, the municipality will impose fines until the structure is dismantled. The amount of the fine is determined by 10-15% of the value of the construction work. If not still demolished, the municipality can dismantle it, but it requires no one in the apartment !!! If you live in the apartment, the matter will proceed by court! Now all the pieces are right. We have wondered why a neighbor comes to bed almost every night at about 23-24 leaves almost an empty apartment and leaves in the morning at about 6-7 am. This is how they want to show that they live in the apartment. The result is that the illegal terrace will eventually be completed. They may pay some fine for a while, but I bet their building’s value is almost worthless, so the fine is small and could be called a rent paid to the municipality for an illegal structure. We would have to take it to court if we want the terrace to be dismantled. At this point, from my experience, I know that the court does not necessarily give the law, but to comply with the law. What are our chances to win? What will everything cost us? One acquaintance went to a much less reason here and eventually, the answer came in 8 years. The Finns won, but not financially.
Rights?
There are fine laws and regulations in Spain that should be followed. What if you don’t follow? Do you pay the fines and how much, and yet the illegal building remains there? What are the rights of someone who is caused by damage? What are the rights of a person who makes illegality? Many years ago, I had to run in court because my company was broken down, destroyed, and stolen by property. In the end, after five trials (3 district courts and 2 Court of Appeal), it was noted that I would not receive any compensation. I was told that if these criminals ever receive tax refunds, they can get something back, provided they regularly renew, and that insurance companies and other official parties will first take their share. I said to another entrepreneur that a crime is a more profitable business than an honest business.

On kohta kulunut jo kaksi viikkoa ja naapuri sen kun jatkaa terassin rakentamista. Muutaman päivän työmaa seisoi, koska sementtipohjan piti kovettua. Edelleen sementti näyttää kuin murokeksiltä, mutta töitä tehdäänkin terassin alla, laiton ylimääräinen huone on valmistumassa. Naapurin asunnosta on tulossa pimeä, koska rakenteilla oleva huone vie kaiken näkymän alakerran ikkunoista, koska huoneen eteen ei tule ikkunaa, vaan ovet. Mieheni muistuttaa, että he ovat romanialaisia ja mistä maasta herra Dracula olikaan kotoisin?
Asut asunnossa, jossa teet laittomuuksia
Sain uutta tietoa parilta ns. tietolähteeltäni, jotka välittivät suoraan otteet Generalitat Valenciana sivustolta koskien rakennusrikkeitä. Luettuani olin kuin maan nielemä. Ensimmäiseksi pitää ottaa kuntaan yhteyttä ja tehdä reklamaatio, kuten olemme jo tehneet toista viikkoa sitten. Kunnan puolesta viranomainen tekee tarkastuksen työmaalle, jonka jälkeen vaatii mahdollisesti rakennelman purkua. Olemme saaneet tiedon, että työmaalle on määrätty rakennuskielto, joka piti tulla tällä viikolla voimaan. Nyt on sunnuntai ja rakentaminen jatkuu. Jos purkua ei tehdä, niin kunta määrää sakot, kunnes rakennelma on purettu. Sakon suuruus määräytyy 10-15% rakennustyön arvosta. Jos ei edelleen pureta, niin kunta voi purkaa sen itse, mutta se edellyttää ettei kukaan asu asunnossa !!! Jos asunnossa asutaan, niin asia etenee oikeusteitse! Nyt kaikki palaset osuvat kohdalleen. Olemme ihmetelleet, miksi naapuri tulee joka ilta noin 23-24 aikaan nukkumaan melkein tyhjään asuntoon ja lähtee aamulla noin klo 6-7 aikaan? Näin he haluavat osoittaa, että asuvat asunnossa. Lopputulema on, että laiton terassi lopulta valmistuu. He ehkä maksavat jotain sakkoa jonkin aikaa, mutta veikkaan, että heidän rakennuskyhäelmän arvo on melkein arvoton, joten sakkokin on pieni, jota voisi kutsua vuokraksi, jonka maksavat kunnalle laittomasta rakennelmasta. Meidän olisi pakko viedä asia oikeuteen, jos haluamme terassin purettavaksi. Tässä kohtaan kokemuksestani tiedän, että oikeudessa ei jaeta välttämättä oikeutta, vaan noudatetaan lakia. Mitkä ovat meidän mahdollisuutemme voittaa? Mitä kaikki tulee meille maksamaan? Eräs tuttu kävi oikeutta paljon pienemmästä syystä täällä ja lopulta vastaus tuli 8 vuoden päästä. Suomalaiset voittivat, mutta eivät rahallisesti.
Oikeudet?
Espanjassa on hienoja lakeja ja määräyksiä, joita pitäisi noudattaa. Mitä jos et noudata? Maksatko sakot ja kuinka paljon, ja silti laiton rakennus pysyy paikalla? Mitkä ovat oikeudet henkilöllä, jolle aiheutetaan vahinkoa? Mitkä ovat oikeudet henkilöllä, joka tekee laittomuuksia? Monia vuosia sitten jouduin juoksemaan oikeudessa, koska yritykseeni murtauduttiin, sitä tuhottiin ja varastettiin omaisuutta. Lopulta viiden oikeudenkäynnin jälkeen(3 käräjäoikeudessa ja 2 hovioikeudessa)todettiin, että en saa mitään korvauksia. Minulle sanottiin, että jos nämä rikolliset joskus saavat veronpalautuksia, niin voit saada jotain takaisin edellyttäen, että uusit vaatimukset säännöllisesti ja, että vakuutusyhtiöt ja muut viralliset tahot vievät ensin oman osuutensa. Totesin toisen yrittäjän kanssa, että rikos on kannattavampaa liiketoimintaa, kuin rehellinen yrittäminen.
